Erica M. Fitzgerald, Esq. is an attorney with the law firm of Littman Krooks LLP.  Her practice focuses on the areas of special education advocacy, guardianships, estate planning, public benefits advocacy and special needs planning.

Ms. Fitzgerald has successfully advocated in impartial hearings, state review proceedings and in state and federal courts for children with special needs who have been denied a free and appropriate public education.  She works collaboratively with clients and school districts to obtain appropriate IEPs and accommodations under Section 504. Ms. Fitzgerald focuses on representing parents of students diagnosed with Diabetes. In addition, Ms. Fitzgerald provides assistance to families in all other aspects of special needs and estate planning, including obtaining guardianships, special needs trusts, advance directives and last wills and testaments.

Prior to working at Littman Krooks, Ms. Fitzgerald served as an Assistant District Attorney for the Bronx County District Attorney’s Office.  She served as an intern at the Social Security Administration and worked as an Activities Director at Astor Gardens Nursing Home in the Bronx.

Ms. Fitzgerald received her J.D. from Fordham University School of Law.  She received her undergraduate degree from Fordham University and also earned a certificate from the New Directions for Attorneys Program from Pace Law School.  Ms. Fitzgerald is a member of the New York State Bar Association (NYSBA), Elder Law and Trusts & Estates Sections of NYSBA, and the Westchester Women’s Bar Association.  She is admitted to the U.S. District Court for the Southern District of New York and the Second Circuit Court of Appeals.

Erica is particularly proud of her work in successfully advocating for students with Section 504-type disabilities and other health conditions. “Schools often misunderstand student needs,” she says, “I work to ensure they are vigilant to protect student health and ensure success.” She frequently presents workshops to parents of students requiring Section 504 Accommodation Plans and Individualized Education Programs.


Erica regularly conducts presentations at Huntington Learning Center and Juvenile Diabetes Research Foundation (JDRF) chapter meetings.
